Arbitration Agreement (U.S.)
Effective Date: August 7, 2025
PLEASE READ: This Agreement affects your legal rights. By using our website, requesting an estimate, or receiving services from Great Day Moving® (“Company,” “we,” “us”), you agree to resolve most disputes through binding arbitration rather than court, with no jury trial or class actions, as explained below.
1) Agreement to Arbitrate
Except for the small-claims option in Section 4 and any temporary/injunctive relief, any dispute, claim, or controversy arising from or relating to our website, estimates, invoices, services, communications, or agreements (collectively, “Claims”) will be resolved by binding arbitration administered by AAA (American Arbitration Association) under its Consumer Arbitration Rules or NAM (National Arbitration and Mediation) under its Comprehensive Dispute Resolution Rules. A judgment on the arbitrator’s award may be entered in any court of competent jurisdiction.
2) Definitions
“You” means the individual or entity engaging with us (and, where applicable, your employees, agents, heirs, assigns).
“Transaction” means requesting an estimate, making a reservation, receiving services, using our site, or entering our premises.
“Equipment/Services” means any moving, packing, hauling, delivery, or related services we provide.
3) Governing Law
This Agreement is governed by the Federal Arbitration Act (FAA). Otherwise, applicable state law governs.
4) Small-Claims Option
Either party may bring Claims in small-claims court where jurisdiction allows, instead of arbitration.
5) Informal Dispute Resolution (Required First)
Before starting arbitration, the initiating party must send a written Notice of Dispute describing the issue, requested relief, and contact info, and allow 30 days for resolution.

6) Arbitration Provider, Rules, and Filing
Arbitration will be administered by AAA (Consumer Arbitration Rules) or NAM (Comprehensive Rules). If the chosen provider is unavailable, the parties will select a comparable forum. Hearings may be in your county of residence, by video, or on documents only (where rules permit).
7) Fees and Costs
Administrative and arbitrator fees will be allocated by the provider’s rules. Each party pays its own attorneys’ fees unless the arbitrator awards otherwise under applicable law. For consumer claims under a modest amount, fee reductions or reimbursements may apply pursuant to the provider’s rules.
8) Individual Actions Only (Class-Action/Jury Waiver)
Claims must proceed on an individual basis. No class, collective, or representative actions are permitted, and there is no jury trial. The arbitrator may award relief only in favor of the individual party seeking relief.
9) Location & Format
Unless both sides agree otherwise, the arbitration hearing (if any) will occur in your county of residence, or by video conference, or on written submissions if allowed by the rules.
10) Arbitrator’s Authority
The arbitrator will:
- Enforce this Agreement and applicable statutes of limitation;
- Decide arbitrability/scope issues;
- Issue a reasoned written award; and
- Grant any relief available in court to an individual party.
11) Opt-Out Right (30 Days)
You may opt out of arbitration within 30 days of first agreeing to these terms by sending your name, contact info, and a clear statement opting out to optout@yourdomain.com or the mailing address above. Opting out does not affect prior arbitrations or other terms.
12) Confidentiality & Protective Orders
The arbitrator may issue appropriate confidentiality/protective orders to safeguard sensitive information.
13) Changes to This Section
If we make a material change to this Arbitration Agreement, we will update the Effective Date. You may reject the change by written notice within 30 days; otherwise, continued use constitutes acceptance.
14) Severability & Survival
If any part of this Arbitration Agreement is found unenforceable, the remainder remains in effect. This section survives termination of your relationship with us.
15) How to Start Arbitration
- Send the Notice of Dispute (Section 5) and wait 30 days.
- File with AAA or NAM under their consumer procedures.
- Send a copy of your filing to services@greatdaymoving.com.
